Bungie Earns Victory In Case Against Multiple Destiny 2 Cheaters, Files Claim Against Ban Evader

Throughout the course of this week, Destiny 2 developer Bungie scored some wins against users manipulating software to gain advantages in gameplay. One of the victories involved would-be defendant Kunal Bunsal, the runner of the website LaviCheats, not showing up to court, according to PCGamer.com, awarding Bungie $6.7 million dollars against the user. This case began in 2021 against several other known cheating platforms, which included Elite tech Boss and VeteranCheats.

Elite Tech Boss settled for $13.5 million in June 2022, while LaviCheats and VeteranCheats failed to respond, the latter to incur a $12 million dollar slap.

Another ruling was against a 17 year old Twitch streamer who was using cheats and ban evading while live streaming. According to a report by TorrentFreak.com, the user has crossed paths with Bungie, who filed a complaint against him in 2022 for the use of various forms of cheating software. After Bungie banned his account, "L.L" (the public moniker the user has been assigned, as he is a minor) would send tweets directed at named members of the staff, which included words like "arson" and "death". 

L.L. would fight defiantly, aiming to have the court dismissed on the grounds that cheating is not illegal, and none of Bungie's rights were being violated. In this on-going story, Bungie is aiming to prove anti-circumvention and copyright violation. 

“The Court is not persuaded by Defendant’s cherry-picked reading of the DMCA that only establishes a violation when the Defendant decrypts, descrambles, or disables Plaintiff’s software,” states Judge Richard A. Jones’ order.

“When read as a whole, the statute clearly states that avoiding or bypassing a technological measure violates the DMCA. Therefore, the Court denies Defendant’s motion to dismiss the circumvention of technological matters claim.”

Bungie will submit its first amended complaint, as this unfolds. Bungie has looked for ways to enforce anti-cheating countermeasures since 2022, as many users continue searching for new forms of software that manipulate the system.
